solving a crime isn't tantamount to passing the sentence, it is the Judge that recommends capital punishment and passes sentence. A Judge doesn't have to recommend capital punishment for murder, they might face criticism for leniency at worst.

It is the fundamental underpinning of western cultural mores, and especially in earlier days authors and artists would include such references and allusions in full confidence their audience would simply take it in their stride. This is addressed in the books. In his last case Poirot is unable to prove the murderer is guilty so he murders the murderer and then stops taking his heart medication because directly killing a person goes against his faith.

Agatha Christie was a member of the Church of England which was much less strict when it came to confession than Catholicism.
