solving a crime isn't tantamount to passing the sentence, it is the Judge that recommends capital punishment and passes sentence. A Judge doesn't have to recommend capital punishment for murder, they might face criticism for leniency at worst.

Agatha Christie was a member of the Church of England which was much less strict when it came to confession than Catholicism.
